1. Acceptance of Terms

3. Account Registration and Security

3.1 Account Creation

To access smtaya's gaming Services, you must register a personal account by providing accurate, complete, and current information as requested in the registration form. Required information includes, but is not limited to, your full legal name, date of birth, residential address, valid email address, mobile phone number, and preferred username. You may only create and maintain one (1) account. Multiple accounts, duplicate accounts, or accounts created under false information are strictly prohibited and will result in immediate closure of all associated accounts and forfeiture of any balances.

3.2 Account Security

Accounts that cannot be successfully verified within thirty (30) days of registration may be suspended or closed.

4. Deposits, Withdrawals, and Payment Processing

4.2 Withdrawals

9. Limitation of Liability

To the maximum extent permitted by Philippine law, smtaya shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Services, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, even if smtaya has been advised of the possibility of such damages. Our total liability to you for any claim arising from or related to your use of the Services shall not exceed the amount you deposited into your account during the six (6) months preceding the event giving rise to the claim.

smtaya is not responsible for any losses resulting from circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, government actions, labor disputes, internet service interruptions, or failure of third-party service providers. This limitation of liability applies to all claims, whether based on contract, tort, strict liability, or any other legal theory.

10. Dispute Resolution and Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute, controversy, or claim arising out of or relating to this Agreement or the Services shall be resolved through good faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the matter to binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. The arbitration shall be conducted in Metro Manila, Philippines, in the English language.

You agree to waive any right to participate in class action lawsuits or class-wide arbitration against smtaya. All claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Notwithstanding the foregoing, smtaya retains the right to seek injunctive relief in any court of competent jurisdiction to prevent or restrain unauthorized use of the Services or infringement of intellectual property rights.

11. Termination

smtaya reserves the right to suspend or terminate your account and access to the Services at any time, with or without notice, for any reason including but not limited to: (a) breach of these Terms and Conditions; (b) providing false or misleading information; (c) fraudulent or illegal activity; (d) failure to complete identity verification; (e) abuse of bonuses or promotions; (f) harassment of other users or staff; (g) extended period of account inactivity. Upon termination, all licenses and rights granted to you under this Agreement will immediately cease.

You may close your account at any time by contacting customer support. Upon account closure, you must withdraw all remaining funds within thirty (30) days. Unclaimed balances may be forfeited in accordance with Philippine escheatment laws. smtaya is not obligated to maintain account records or transaction history beyond the period required by PAGCOR regulations.
